Products Ratings and Reviews Terms of Use

Thank you for visiting the Watier Brand website (the "Site"). We want the reviews on our Site to stay honest, respectful and helpful for everyone. These terms of use (the "Terms of Use") govern your submission, posting and use of product reviews and other user-generated content on the Site, including through the "Write a Review" feature (collectively, "User Content"). By submitting or posting User Content, you agree to be bound by these Terms of Use. If you do not agree, please do not submit or post User Content.

These Terms of Use apply only to individuals who submit or post User Content, including product ratings, reviews, comments, photographs, videos or other materials made available through the Site's review or user-content features. They apply in addition to the general Terms of Use and the Privacy Policy of Groupe Marcelle's Site. If there is any conflict between these Terms of Use and the Site's general Terms of Use, the general Terms of Use will control.

We may change these Terms of Use from time to time on a going-forward basis. The version posted on the Site when you submit or post User Content will apply to that submission. We may provide notice of material changes through the Site or by email, where appropriate.

1. Privacy

Personal information submitted with or in connection with User Content will be collected, used, disclosed and protected in accordance with the Privacy Policy made available on the Site. Any personal information you include in your User Content, such as your name, may be seen by anyone who visits the Site, so please leave out anything you wish to keep private. Do not include sensitive personal information in a public review or other User Content. If you submit your email address in connection with your User Content, you agree that Groupe Marcelle and its third-party service providers may use it to contact you about the status of your review and for related administrative purposes.

2. Eligibility

You represent and warrant that you are at least 18 years old. If you are under 18, you represent and warrant that you are at least 14 years old and that you are submitting User Content under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use. You also represent and warrant that you have the legal capacity to agree to these Terms of Use.

3. User Content and Reviews

The Site may allow you to submit product ratings, reviews, comments, photographs, videos and other materials relating to your experience with products or services. You are solely responsible for the User Content you submit. User Content must reflect your honest opinions and actual experience, and any material connection, incentive or benefit associated with a review, including a product received free of charge as part of a sampling campaign, must be clearly disclosed. You represent and warrant that you are the sole author of your User Content, that you own or control all rights necessary to submit it, and that its submission, publication and use as permitted by these Terms of Use will not infringe any third-party rights, violate applicable law or cause injury to any person or entity.

4. Review and Moderation

We are not required to prescreen, monitor or verify User Content or the identity of contributors. We may, at our discretion and without notice, review, edit, refuse, block, move or remove User Content that violates these Terms of Use, applicable law or the intended purpose of the review feature. We may also preserve and disclose information where reasonably necessary to comply with law, enforce these Terms of Use, address fraud, security or technical issues, respond to support requests, or protect rights, property or safety.

 

5. User Conduct

You may submit User Content only for lawful purposes and in accordance with these Terms of Use. You must not submit any content that:

  • you know to be false, inaccurate or misleading; 
  • is unlawful, defamatory, libelous, abusive, threatening, harassing, obscene, hateful, discriminatory, racially or religiously biased or offensive, commercially promotional or otherwise inappropriate; 
  • violates any law or regulation, including those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising;
  • infringes any copyright, patent, trademark, trade secret or other intellectual property right, or any right of privacy or publicity; 
  • contains confidential information, personal identification documents or sensitive financial information; • references other websites, or includes addresses, email addresses, contact information or phone numbers; 
  • contains viruses, worms, malware or any other potentially harmful code, files or programs; 
  • impersonates another person; or • is submitted in exchange for an undisclosed payment, gift or other incentive.

6. No Endorsement

 User Content reflects the views of its contributors and does not necessarily reflect the views of Groupe Marcelle. We do not endorse User Content and make no representation or warranty as to its accuracy, completeness, reliability or quality. To the extent permitted by law, we disclaim responsibility for User Content posted by users. 

7. Licence to Use User Content

 By submitting User Content, you grant Groupe Marcelle and its service providers a non-exclusive, worldwide, royalty-free, fully paid, transferable and sublicensable licence to host, store, reproduce, publish, display, distribute, adapt, translate and otherwise use the User Content for operating, moderating, promoting and improving the Site, its review features, and the products or services to which the User Content relates, in any media now known or later developed. This licence continues for as long as reasonably necessary for those purposes, subject to applicable law and the Privacy Policy. Where permitted by law, you waive any moral rights you may have in the User Content. We are not required to use any User Content or to provide notice, credit or compensation for its permitted use.

8. Intellectual Property

The Site and its content, excluding User Content, are protected by intellectual property laws and are owned by or licensed to Groupe Marcelle. No rights in the Site or its content are granted except as expressly stated in these Terms of Use.

9. Account and Posting Privileges

Where an account is required to submit User Content, you are responsible for keeping your credentials confidential and for activity occurring through your account. We may suspend or terminate your account or your ability to submit User Content if you violate these Terms of Use or misuse the review feature.

10. Disclaimer

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE USER-CONTENT AND REVIEW FEATURES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT USER CONTENT WILL BE ACCURATE, COMPLETE, RELIABLE, AVAILABLE, SECURE OR FREE FROM ERRORS OR HARMFUL COMPONENTS.

11. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Groupe Marcelle, its affiliates and their respective directors, officers, employees, agents, contractors and service providers from claims, liabilities, damages, losses, costs and expenses arising from your User Content, your breach of these Terms of Use, or your infringement of any third-party rights.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, GROUPE MARCELLE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATING TO USER CONTENT, THE REVIEW FEATURES, OR THE REMOVAL OR FAILURE TO REMOVE USER CONTENT. NOTHING IN THESE TERMS OF USE EXCLUDES OR LIMITS LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

13. Termination 

We may suspend or terminate access to the User Content and review features, and may remove User Content, at any time where reasonably necessary to enforce these Terms of Use, comply with law, protect the Site or its users, or discontinue the feature. Provisions that by their nature should survive termination will continue to apply.

14. Governing Law and General Provisions

 These Terms of Use are governed by the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Subject to applicable consumer-protection law, the courts of Quebec have exclusive jurisdiction over disputes relating to these Terms of Use. If any provision is found invalid or unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Together with the Site's general Terms of Use and Privacy Policy, these Terms of Use constitute the entire agreement concerning User Content and reviews.

 Questions, complaints or notices regarding User Content or reviews may be submitted through the contact method identified on the Site. We may provide notices regarding these Terms of Use or the review features electronically, through the Site or using the contact information associated with your account.
